Editorial policy and ethical standards

Editorial policy and ethical standards are designed according to recommendations of Committee on Publication Ethics (COPE) and Ethical code of scientific professional of Ukraine approved by the General meeting of National Academy of Sciences of Ukraine dated April 15 2009.

 Yearly journal of scientific articles “Pravova derzhava” publishes reviewed original research articles in accordance with the themes of the edition, report on the activity of the Institute for the previous year, reviews, surveys, information on scientific life and etc. The publisher of the above mentioned journal is V.M. Koretsky Institute of State and Law, National Academy of Sciences of Ukraine.

 Editorial policy of the journal is based on objectivity and impartiality when choosing articles for publication; high standards as for quality of research results given by the author (co-author) in the research article submitted for the publication; the articles have to be reviewed in confidentiality; no authors' rights or allied rights shall be breached (we conclude license agreement with each and every author (co-author).

 When we publish yearly journal of scientific articles “Pravova derzhava”, editors office has to comply with requirements as for selection of research articles. Each and every author, editor, reviewer and publisher ought to prevent illegal releases.

Ethics of publications

“Pravova derzhava” publishes only those materials which the reviewers have approved. All articles sent to editorial board have to comply with journal profile and pass review stage. Reviewers select only the best authors’ submissions for publication and if necessary they give recommendation how to improve certain articles. Review is meant to impartially evaluate content of the scientific article highest possible and check if it meets journal requirements. It stipulates full-scale analysis of advantages and disadvantages of the article materials. Only articles valuable in science terms and addressing the relevant issues and tasks of state and law formation shall be published. Also we consider if the article is prepared in accordance with the publication rules for scientific journal (see Execution requirements for the articles)
Materials sent to the editors’ office are subject to double-blind review carried out by two independent reviewers being impartial and following highest international and national academic standards of quality.

Ethical obligations of journal editorial board

  1. Editorial board is liable for quality of all materials which are published in the journal. That’s why all submissions are selected and reviewed. Editorial board reserves the right to decline the articles if it considers that the work doesn’t meet the profile of the journal or the authors have breached technical or ethical standards given below or send it back to improve it. In such case the author has to revise the articles pursuant to the remarks of the editorial board. It’s the chief editor who makes the final decision on publication of the research article in the journal. And academic board of the Institute shall approve content of the edition.
  2. Editorial board considers submissions without prejudice irrespective of race, gender, sexual orientation, religious beliefs, ethnical origin, nationality and political beliefs of the authors, as well as their place of employment. The members of the editorial board ought to respect intellectual independence of the authors.
  3. Editorial board and reviewers monitor materials to exclude falsification, brain picking and text recycling (within the meaning of §4 art. 42 Law of Ukraine “On education”), multiple copying of similar information in different articles, doubtful authorship or false representation of the authors’ real works.
  4. Editors’ office reserves the right to stylistically correct the submission. Final text of the article shall be agreed with the author in advance.
  5. No submissions shall be returned or published in other scientific journals.
  6. The members of the editorial board shall not be entitled to disclose any information on the submissions being reviewed except for respective author, reviewer, other editorial consultants, members of the Academic board of the Institute, and if necessary, publisher.
    Unpublished materials used in the submission shall not be used by the members of the editorial board for their own research and other persons involved in the publishing of the journal without written consent of the author.
    Restricted information or ideas received within reviewing shall remain confidential and shall not be used for personal benefit.
    Editors, authors and reviewers have to inform on their competing interests which may affect objectivity when editing and reviewing materials of the articles. Such interests may be of intellectual, financial, personal, political, religious nature and etc. If the conflict of interests was revealed after release, and it caused falsification of reviewing, appropriate acts shall be taken, for instance, publication of amendments, contradiction or apology.
  7. If ethical claim on the submission or published article is filed, the chief editor has to take reasonable measures. Such actions include contact with the author of the article (if necessary with respective scientific organization) and appropriate objective and full scale consideration of the respective complaint or claim. If there is conflict of interests the chief editor has to state a recusal and assign editor-in-charge or other member of editorial board to consider a claim or complaint.
    If there is convincing evidence that main content or conclusions of the work published in the journal is false or the author breached other ethical standards, editorial board shall be obliged to publish respective notification on false content or conclusions and if the submission is not published yet – to correct the mistakes or decline the submission. The person who noticed mistake or independent author may prepare respective contradiction.
    Each and every message on unethical behaviour should be considered even if it was sent in many years after release.

Ethical obligations of the authors

  1. The author shall be held liable for the article content and its publication. Under no circumstances brain picking shall be presented as original work and no article which was published before shall be submitted for publication. In case if brain picking is revealed, authors who submitted the materials shall be held liable for that. The authors shall clearly and unambiguously word main head-notes and conclusions so that no data were falsified or misrepresented.
  2. The author shall be held liable for reliability of information in the article, accuracy of the names, statistical data, surnames, quotations, as well as available permission to disclose personal or confidential data including restricted information in the research (secret or non-public information).
  3. The author has to quote publications which considerably influenced development of the problem under study as well as those which introduce earlier works yet important for the understanding of the present research. The authors ought to indicate sources of quoted or provided information, refer to actually used latest editions of regulatory enactments and complete references to used sources in accordance with Execution requirements for articles.
  4. All persons who contributed to the presented work and share liability for the obtained results shall be co-authors. Other contributions shall be marked in notes or in the text as credits.
  5. The author has to inform editorial board on any potential conflict of interests which in their judgement may affect the release of the submission.
  6. The author of the publication shall be obliged to properly react on information given in the complaint as for their release or have good reasons not to react to it.

Ethical obligations of the reviewers

  1. All articles sent to the journal shall be reviewed. Review is carried out confidentially according to double-blind review (when neither author nor reviewer knows each other). The editor-in-chief of the journal shall coordinate work of an author and the reviewers
  2. The reviewer has to impartially evaluate the quality of the submission, theoretical and practical value of the work, accuracy of statements and conclusions and check if the submission meets high scientific standards.
  3. The reviewer ought to respect intellectual independence of the authors and treat the submission for review as a confidential document. The reviewer has no right to use or disclose unreleased information, arguments or interpretations which the present submission contains unless the author has given their consent.
  4. The reviewer shall provide feedback on the submission on time.
  5. The reviewer shall appropriately explain and argue in favour of their judgement for the authors and editors to understand what the reasons for criticism are. Any statement on the fact that any insight, conclusion or argument has been already released earlier shall have respective references.
  6. The reviewer shall mark any cases if the authors do not properly quote works of other scientific professionals which are tightly related to the submission to be reviewed; also they have to draw editor’s attention to any considerable similarity between the submission and any published article.

Freeware distribution of scientific information

Yearly journal of scientific articles “Pravova derzhava” is a scientific periodical freely available (overview, reading, downloading and printing are free). The journal is available online after the journal is published on paper and uploaded on its official website and other information resources.
According to the laws as for compliance with author’s right, the materials of the published article in the journal shall not be reproduced completely or partially in any form (electronic or paper one) without prior written consent of the authors. If published materials are used in the context of the other documents the references to the original source shall be indicated. Any articles from the journal or their extracts may be electronically distributed but such distribution shall stipulate obligatory references to the original source. It is forbidden to publish and/or distribute the materials of the journal on paper or hard computer media by third persons or organizations.
