Andriyko Olga, Zavalna Zhanna. Powers of military administrations and executive authorities regarding the contractual regulation of relations during wartime
This article considers the possibility of applying contractual regulation of relations in wartime by military administrations. As a result of the analysis of statutory regulations, the peculiarity of regulation of relations on a contractual basis was revealed. One part of the powers establishes the possibility of applying contractual regulation of relations by the military administrations themselves, i.e. direct regulation. Such direct regulation includes both the possibility of applying certain forms of contractual regulation and limiting their application by type of relationship.
The second part of the powers relates to the regulation of contractual relations in which the military administrations themselves are not directly subject, but, due to the application of administrative infl uence, acquire the right to infl uence contractual regulation between other subjects, individuals and legal entities of civil, economic, commercial, labor law. Such powers concern contractual relations of other subjects indirectly and it is possible to speak about indirect regulation. It is established that military administrations and executive authorities exert indirect infl uence on the contractual regulation of relations both independently and together with the military command of the Armed Forces of Ukraine. Indirect regulation of contractual relations has several areas of infl uence. These infl uences concern the terms of contracts, the subject matter, organization (control) of the implementation of contracts.
The article draws attention to the fact that the legal regime of wartime provides for the establishment of restrictions on the application of contractual regulation of relations by time, type, subject, object of the contract, and a absolute prohibition on concluding certain types of contracts (contracts for the sale of weapons, drugs, alcohol).
