Sytar Mariana. The development of comparative studies in Germany in the 19th and 20th centuries

This article aims to obtain comprehensive scientifi c knowledge on the transformations of comparative law in Germany in the context of its development in the 19th and 20th centuries. The relevance of the study is determined by the fact that comparative law is one of the most dynamic areas of legal science, which allows us to understand the modern development of jurisprudence in general. In addition, German lands have become the historical home of comparative law, and German scientific schools remain one of the leading and most outstanding till nowadays. In view of this, the generalization of their achievements is of undeniable importance both for understanding the national peculiarities of the development of this fi eld, and for understanding the future prospects for the development of comparative law in general.

Comparative law in Germany has gone through several stages of its development, which are closely connected with the historical moments of the country’s development as a whole. Legal comparative studies in Germany can be divided into the following stages: the fi rst – covers the period between 1789 and the First World War (1914-1918); the second – the Golden Age, which lasted from 1919 to 1933; the next stage was the stage of actual “nazifi cation” of legislation, which lasted from 1933 to 1950; the fourth one is the so-called “restoration”, which lasted from 1950 to 1989, although it is believed that the restoration of comparative law at the international level began in the late 1940s. The fi nal stage is the so-called harmonization, which provides for new approaches to comparative law and began after 1989.

Comparative law in general is a fairly young institution. However, despite all the historical moments in the development, comparative studies are developing quite intensively, off ering new approaches to understanding, continuing institutionalization, and preserving the experience of the past.
