Taking into account that development of rural areas depends very much on the share of family farms in the structure of agricultural producers of the country, the necessity of legislative support for transformation of a part of non-commercial subsidiary farms into commercial family farms is substantiated. It is proposed to introduce to the Law of Ukraine «On private farm» changes aimed at enabling creation and activity of private farms of three types: private farms as legal entities, family farms without status of legal entity and private farms as a form of farming of individuals which are subjects of entrepreneurial activity in agriculture. It is also proved that there is the necessity of formation of two legal mechanisms of subsidiary farms transformation into family farms. The first of them has to stimulate unification of efforts of small agricultural producers by the way of creation by them of agricultural service cooperatives, and second one – on the basis production cooperation of small agroproducers with big and medium agricultural enterprises.
