The article deals with the formation of new concept – general theory of international and municipal law. Original elements of such a concept are analyzed within the theories of the past. In such context genesis of international and municipal law is studied, as well as influence of globalization on correlation of both systems and primacy of international law. Due attention is paid to possibilities of general theory to solve conflicts between international and municipal law.
